In Treaties with Native Americans: Evidence of the Legal Existence of the United States, Roxanne Dunbar-Ortiz comments on 1) treaties between the United States and Native Americans and 2) treaties between States with provisions affecting Native Americans as third parties. This paper was contracted in response to the Special Rapporteur on Indigenous Right’s decision to explore circumstances under which indigenous peoples were affected by states and colonial powers that encountered them.

This document transmits the conclusions and recommendations agreed upon by participating experts on the Seminar on Treaties, Agreements and other constructive arrangements between States and indigenous peoples organized by the UN High Commissioner for Human Rights. The report was submitted to the Working Group on Indigenous Populations at its twenty-second session. The Experts note that “treaties, agreements and other constructive arrangements between States and indigenous peoples have not been respected, leading to loss of lands, resources and rights, and that non-implementation threatens indigenous peoples’ survival as distinct peoples” and that “historic treaties, agreements and other constructive arrangements between States and indigenous peoples should be understood and implemented in accordance with the spirit in which they were agreed upon” (paragraph 2).
