The Proposed American Declaration on the Rights of Indigenous Peoples was drafted by the Inter-American Commission of Human Rights and approved on February 26, 1997. It is currently being considered by the Working Group to Prepare the Proposed American Declaration on the Rights of Indigenous Peoples, a group of OAS member states and indigenous representatives.

This statement, presented by U.S. delegate Bruce Wilson on April 5, 2002 before the Working Group to Prepare the Draft American Declaration on the Rights of Indigenous Peoples, stresses the importance of trust between a State and the indigenous peoples within that State as being a prerequisite to discussing land ownership and jurisdiction. The United States admits that historically it was unfair and exploitative in its dealings with tribes and stresses its current effort to establish trusting, fair and respectful relationships with tribes. The United States also provides an outline of its current law and policy regarding indigenous lands.

In this opening statement of the U.S. delegation to the Working Group, the delegation presents the Unites States’ position with regard to self-determination, collective rights and identification. The United States says that it will support the terms “internal self-determination” and “peoples,” that it will support some measure of collective rights as they pertain to indigenous communities; and that it does not support State identification of indigenous peoples unless undertaken through a fair and open process.
